صِناعَةُ الفَتوَى عندَ الشَّرِيفِ التِّلمسَانِي ووَلَدَيه

Résumé: الملخص باللغة العربية: تُعَدُّ الفتوَى من الخِطَطِ الشَّرعيَّةِ التي يَتَصدَّرُ فيها الفقهاء لبيان الأحكام الشَّرعيَّة للمستفتِينَ، وهي تَوقِيعٌ عن ربِّ العالمين؛ ولا يَتَصَدَّى لها إلاَّ من كان له باعٌ من موارد الاجتهاد وآليَاتِه، وهي صناعة لا بُدَّ أن يُحْكِمَ الفقيه فيها كلَّ مقومَاتِ المجتهدِ العارفِ بالنَّصِّ الشَّرعيِّ والواقع المعاش، حتَّى لا يُعَابَ عليه إنتاج الحكم الشَّرعيِّ، ولقد بَرَزَ في المذهب المالكي بحاضرة تلمسان مجموعةٌ من المجتهدين الأعلام من عائلة الشَّريف أبي عبد الله الحسني، ونُقِلَتْ عنهم مجموعة من الفتاوَى الفقهيَّة والعلميَّةِ، تدُلُّ على عُلُوِّ كعبِهِم وإحَاطتِهِم بفرُوعِ المذهب وأصولِه، ومعرفتِهم بواقِعِ مجتمَعِهم، وذلك ما يَظْهَرُ من خلال نُصوصِ فتاوِيهم المدرَجَةِ في المعيار المعرب أو الدُّررِ المكنونة في نوازل مازونة. والصِّناعَةُ الفقهيَّةُ في الفتوى بالإضافة لامتلاك آليات ومقوِّمَاتِ الاجتهاد، تَتَوَقَّفُ على معرِفَة فتاوَى المتَقَدِّمِينَ واستثمَارِها في العمليَّة الاجتهادية المعاصرة. الملخص باللغة الإنجليزية: The fatwa is one of the legitimate plans in which the jurists are leading to explain the legitimate provisions of the respondents. It is the signature of the Lord of the Worlds. It is only addressed by those who have sold the resources of ijtihad and its mechanisms.
