الدّلالة اللّغويّة والدّلالة الاصطلاحيّة لمصطلح "الخلع" و"الطلاق" في قانون الأسرة الجزائري

Résumé: تهتم هذه الدّراسة بواقع المصطلح القانوني، وما يشهده من اضطراب في الصيغة والمفهوم، بحيث تمثل المصطلحات القانونية إحدى الركائز الأساسية التي تقوم عليها المعرفة العلمية في مجال القانون، وهو أداة القراءة الأولى، ووسيلة الفهم الصحيح، وشرط الكتابة القانونية السليمة. وجاءت هذه الورقة البحثية لدراسة مصطلح الخلع والطلاق في قانون الأسرة الجزائري، وكيف عالج المشرع الجزائري هذين المصطلحين، و العودة إلى جذور المصطلحين اللّغوية وتفحص معانيهما ومقارنهتها بما جاء في الاصطلاح وفي المعاجم المتخصصة والنصوص القانونية. فقد أصبح المصطلح اليوم أحد مؤشرات الرئيسية للتقدم العلمي، وهذا نتيجة البحث المطّرد في سائر مجالات الإنتاج والإبداع والعطاء، وكذلك ضبط مصطلحات هذا العلم، وتحديد دلالاتها فهو يساعد المهتم بالحقيقة العلمية من الفهم الصحيح والوقوف على المعنى المراد. This study is concerned with the reality of the legal term, and the disorder witnessed in the form and concept, so that legal terms represent one of the main pillars upon which scientific knowledge in the field of law is based, and it is the first reading tool, the means of correct understanding, and the condition of sound legal writing. This research paper came to study the term "Khul’a" and "Divorce" in the Algerian family law, and how the Algerian legislator dealt with these two terms, and to return to the roots of the two linguistic terms and examine their meanings and compare them with what came in the terminology and in specialized dictionaries and legal texts. Today, the term has become one of the main indicators of scientific progress, and this is the result of continuous research in all areas of production, creativity and giving, as well as controlling the terminology of this science, and defining its connotations.
