حقوق وواجبات الموظف العام دراسة مقارنة بين الأمر 06/03 و قانون الخدمة المدنية المصري رقم81 لسنة 2016

Résumé: ملخص: يعتبر الموظف العام أحد اهم وسائل قيام و استمرار المرفق العام فالأشخاص المعنوية العامة ليس بإمكانها تسيير الأعمال الادارية إلا عن أشخاص طبيعيين لهم صفة الموظف،و لا بد لهذا الأخير خلال مساره الوظيفي أن تكون له حقوق يقابلها واجبات،هذه الواجبات هي السبب المباشر في استمرار نشاط الادارة،في حين تعتبر الحقوق أسبابا مشجعة لبقائه في منصبه و قيامه بالأعمال المسندة اليه،و تنقسم هذه الحقوق غالبا الى حقوق مالية و أخرى وظيفية أو مهنية،في حين تنقسم الواجبات الى ايجابية و أخرى سلبية. ABSTRACT: The functionary is considered as one of the most important means for the public establishment and its bearing. Public bodies can only perform administrative work through natural persons who have the status of employees. This latter, must have rights in return for duties during their career. These duties are the direct reason for the continuation of administration activity. However, the rights are considered as motivating reasons for them to retain their posts and perform the tasks assigned to them. These rights are often divided into other financial rights and functional or professional ones while obligations are divided into positive duties and negatives one.
