Résumé: لا يختلف الت ا رضي في العقد الالكتروني عن العقد التقليدي لأن كلاهما ينعقدان بتوافق الإ ا ردتين، غير أن العقد التقليدي يتحقق بالتواجد المادي للأط ا رف المتعاقدة، خلاف العقد الالكتروني الذي يتم عن بعد دون حضور فعلي للمتعاقدين، فيبرم بواسطة وسائل إتصال حديثة عبر الانترنت، حيث يتبادل الأط ا رف الايجاب والقبول عبر الطرق التي يختارونها، فلهم الحرية الكاملة في اختيار إما بالكتابة أو بالإشارة أو الكلام ... و لا يكون التعبير عن الإ ا ردة صحيحا إلا إذا كان صاد ا ر من ذي أهلية قانونية وتكون هذه الأهلية سليمة غير مشوبة بأي عيب من عيوب الإ ا ردة ، والتي سعى الفقهاء والعلماء المختصين في مجال الفن وتقنيات الإتصال الحديثة للبحث عن وسائل تقنية للتحقق منها، كون العقد يبرم في مجلس إفت ا رضي، فتوصلو بمحاولاتهم إلى : البطاقات البنكية، والرسائل التحذيرية أو اللجوء لوسيط إلكتروني. وأما عن إثبات الت ا رضي في العقد الإلكتروني فقد أقر المشرع الج ا زئري وأخذ بالكتابة والتوقيع الإلكترونيين كوسيلة إثبات، وساوى الكتابة الالكترونية بالكتابة الورقية في الحجية. Summary of the thesis: Consent in an e contract is not different from a traditional contract because both are concluded by the agreement of the parties' wills. However، the traditional contract is fulfilled by the physical presence of the contracting parties، unlike the e contract، which is concluded remotely without the actual presence of the contracting parties and is made through modern communication methods over the Internet، where the parties exchange acceptance and consent through the methods they choose. They have complete freedom to choose whether by writing، sign or voice... The expression of will is only valid if it is issued by a person with legal capacity and this capacity is legitimate and free from any defect of will، which the jurists and experts in the field of art and modern communication technologies have sought to find technological means to verify them because the contract is concluded in a virtual council. They have reached their attempts to: bank cards، warning messages، or resorting to an electronic intermediary. Regarding the proof of consent in the e contract، the Algerian legislator acknowledged and took into account electronic writing and signature as a means of proof، and equated electronic writing with paper writing in evidence.
