جرائم الاعتداء على البيئة بين الفقه الاسلامي والتشريع الجزائري - الجرائم الواقعة على الغابات أنموذجا

Résumé: "تعتبر حمايه البيئة من أعقد قضايا العصر التي تستحوذ على اهتمام المختصين في شتى المجالات ومختلف المجتمعات الانسانية مهما تباينت نظمها القانونية والاجتماعية، فالمخاطر التي تحيط بها وما يشوبها من تهديدات اضحت نوعا من التحدي الذي يتعين على الانسان أن يواجهه بشتى الطرق. ولقد تناولنا في هذه المذكرة: ""جرائم الاعتداء على البيئة بين الفقه الإسلامي والتشريع الجزائري – الجرائم الواقعة على الغابات أنموذجا -"". ويتبلور الإشكال الرئيس لهذه الدراسة في التساؤل الآتي: كيف عالج الفقه الإسلامي والتشريع الجزائري الاعتداءات الواقعة على البيئة بمختلف صورها؟ وحاولنا الإجابة على هذا التساؤل من خلال خطة مكونة من مقدمة، وثلاثة مباحث، وخاتمة، وفهارس. بدأنا الدراسة بتوضيح ببعض المفاهيم التي لها صلة بالبيئة والجرائم البيئية وجرائم الاعتداء على الغابات بين الشريعة الإسلامية والقانون الجزائري، ثم تطرقنا إلى مفهوم جرائم الاعتداء على الغابات وأنواعها والآثار المترتبة عنها في الشقين الشرعي والقانوني، وفي الأخير تعرضنا إلى العقوبات والجزاءات التي قررها كل من الفقه الإسلامي والتشريع الجزائري لجرائم الاعتداء على الغابات ثم التدابير الاحترازية والوقائية لمكافحة هذه الجرائم. وقد أبانت الدراسة مجموعة من النتائج أهمها: - أن الاهتمام بالجانب البيئي في الشريعة الإسلامية قديم منذ (14¬¬¬¬¬¬¬) أربعة عشرة قرنا. - القوانين الوضعية هي الأخرى حذت حذو الشريعة الإسلامية واجتهدت في وضع ضوابط وتدابير وقائية لحماية البيئة. وحوت خاتمة البحث أهم النتائج والتوصيات المستخلصة من الدراسة، ثم ختمت الدراسة بفهارس فنية كاشفة عن مضامين الرسالة. "This study has dealt with:""Crimes of assault on the environment between Islamic jurisprudence and Algerian legislation -Crimes against forests a model"". The study aims to shed light on the extent to which the Islamic jurisprudence and the Algerian legislation succeed in setting the legal constraints and the legal frameworks that guarantee the protection of the environment from all crimes committed against it. The structure of this research consists of: an introduction, three sections, a conclusion, and indexes. We started the study by clarifying dealt with some concepts relating to the environment, environmental crimes and the crimes of assault on the forests between the Islamic jurisprudence and the Algerian legislation, Then we touched on the concept of crimes against forests ,their types and their legal implications in the jurisprudence and the legislation, Then we touched on the concept of the penalties and sanctions established by both Islamic jurisprudence and Algerian legislation for crimes against forests as well as the precautionary and preventive measures to combat such crimes. The study has shown a series of results,The most important of which were the following: First, the environmental aspect has been the major interest of the Islamic law for 14 centuries. Man-made laws too, followed the example of Islamic Sharia and worked hard to put in place controls and preventive measures to protect the environment. The conclusion of the research includes the most important findings and recommendations. The study has been then concluded with artistic indexes revealing the dissertation's contents.
