المحكمة الدستورية بين مستجدات النص الدستوري واشكالية تفعيلها
Résumé: بموجب التعديل الدستوري لسنة 2020 تخلى المؤسس الجزائري عن المجلس الدستوري الذي استمر تطبيقه منذ دستور 1963 حتى التعديل الدستوري لسنة 2016 واستبدله بالمحكمة الدستورية مما تتطلب، ومن جديد اعادة النظر في شروط العضوية وضمانات استقلاليتها إضافة الى توسيع صلاحياتها، وهذا يعد تطور دستوري في مجال الرقابة الدستورية. According to the constitutional amendment of 2020, the Algerian founder abandoned the Constitutional Council, which continued to be applied since the 1963 Constitution until the constitutional amendment of 2016 and replaced it with the Constitutional Court, which requires, and once again, a review of the terms of membership and guarantees of its independence in addition to the expansion of its powers, and this is a constitutional development in the field of constitutional oversight.
