تجليات فقه الواقع عند الإمام القرافي تأصيلا وتطبيقا

Résumé: من معالم المنهج الوسطي فقه الواقع وإدراكه على ما هو عليه، قصد تطويعه وتسديده بأحكام الشرع، والإمام القرافي واحد من العلماء الذين عنوا بفقه الواقع تأصيلا وتطبيقا، إدراكا منه بأن أحوال الناس متغيرة بتغير الزمان والمكان والظروف والأعراف، وأن المنهج الحق عدم الجمود على المنقولات مع تغير مدركها، وكان هذا المسلك بارزا في مؤلفاته، نبّه عليه، والتزمه في فقهه واستدلاله، ومن تجلياته: فقه واقع النصوص؛ من خلال أسباب نزوها وورودها، والقرائن المحتفة بها، والتمييز بين مقامات التصرفات النبوية. فقه واقع تنزيل الأحكام؛ من خلال تأصيله قاعدة تغير الفتوى، وأسباب التغير، واعتبار مقاصد المكلفين، وقرائن أحوالهم، كل ذلك وفق منهج وسطي يميّز بين الثوابت والمتغيرات، يراعي فقه الموازنات ويعتبر مآلات تطبيق االأحكام. Abstract: The jurisprudence of reality and its realizing is one of the moderation methodology's features, it adapts it to the Islamic law. Imam Al-Karafi is an Islamic scholar who is interested in it since he knew that people's situations change according to time, place, conditions and conventions, and that the right methodology does not stick to inheritance. This approach was relevant in his works, he committed to it in his jurisprudence and reasoning.
