إعمال مقاصد الشريعة في حكم العمل بالحديث النبوي
Résumé: يتناول مقالي الموسوم بــ: (إعمال مقاصد الشريعة في حكم العمل بالحديث النبوي) دراسة تطبيقية عن حكم العمل بالحديث النبوي بإعمال مقاصد الشريعة حسب اختلاف الزمان والمكان والحال والعرف، وذلك باختيار بعض الأمثلة من الأحاديث التي اجتهد فيها بعض الصحابة والأئمة، بناء على إعمال الاعتبارات المقاصدية عند تطبيقهم لتلك الأحاديث. ويهدف البحث إلى بيان أهمية اعتبار مقاصد الشريعة في دراسة السنة النبوية وربط فهم الحديث والعمل به بتلك المقاصد، ويتوقع أن يخلص البحث إلى نتائج من أهمها: تأثير المقاصد الشرعية في تغيّر حكم العمل بالحديث النبوي بناء على تغير الزمان أو المكان أو الحال أو العرف. My article entitled: (Implementation of the Objectives of Sharia in the Ruling of Acting the Prophetic Hadith) deals with an applied study on the ruling of the Prophet’s Hadith by implementing the objectives of Sharia according to the difference of time, place, situation and custom, by selecting some examples from the hadiths in which some of the Companions and Imams worked hard, based on the implementation of the intended considerations when Their application to those hadiths.
