إشكالية التوازن المعرفي في عقود التجارة الإلكترونية Problem Of Knowledge Balance In E-commerce Contracts

Résumé: تهدف هذه الدارسة البحثية إلى تسليط الضوء على الآليات التي وضعها المشرع بغرض حماية التوازن المعرفي في عقود التجارة الإلكترونية في القانون رقم 09 / 03 المتعلق بحماية المستهلك والقانون رقم 18 / 05 المتعلق بالتجارة الالكترونية ، وذلك من خلال دراسة وصفية تحليلية للأحكام ، لاسيما في قانون التجارة الإلكترونية . وتبين لنا من خلال تفاصيل هذه الدراسة، أن قانون حماية المستهلك يُطلب من كل تاجر إلكتروني إبلاغ المستهلكين، عن طريق وضع الملصقات أو العرض أو أي وسيلة أخرى مناسبة، بجميع المعلومات ذات الصلة بالمنتجات التي يعرضها للاستهلاك، بالاضافة إلى منح المستهلك الالكتروني مجموعة من الضمانات إذا فشل المورد في الوفاء بمواعيد التسليم النهائية يمكن المستهلك الإلكتروني العدول بالاضافة إلى تسلّيم المورد الإلكتروني منتوجا أو خدمة غير مطلوب من المستهلك. Abstract: This research study aims to highlight the mechanisms developed by the legislator to protect the knowledge balance in electronic commerce contracts in Act No. 09/03 on consumer protection and Act No. 18/05 on electronic commerce, through an analytical descriptive study of the provisions, particularly in the Electronic Commerce Act. From the details of this study, we have found that the Consumer Protection Act requires every electronic merchant to inform consumers, By placing stickers, displays or any other appropriate means in addition to giving the e-consumer a range of guarantees if the supplier fails to meet the deadlines, the e-consumer can return in addition to receiving the e-supplier a product or service not required of the consumer.
