خصوصية التوقيع الالكتروني في العقد التجاري الالكتروني على ضوء القانون رقم 18-05
Résumé: إن معالم التجارة الالكترونية اليوم أصبحت أكثر وضوحا وتخصيصا لاسيما بعد صدور القانون رقم 18-05 المؤرخ في 10 مايو سنة 2018 المتعلق بالتجارة الالكترونية, وبالتالي توضح هذه الدراسة خصوصية العقود المبرمة في ظل هذا القانون سواء من حيث الأطراف أو من حيث وسيلة الإثبات, بالإضافة إلى تبيان تحول موقف المشرع الجزائري من مسألة تطويع القواعد القانونية الموجودة قبل إصدار قانون خاص بالتجارة الالكترونية خاصة مسألة الإثبات لتتلاءم والمعاملات الالكترونية إلى مسألة إصدار قوانين خاصة وأخرى ذات صلة لاسيما صدور القانون رقم 18-04 المؤرخ في 10 مايو سنة 2018 المنظم لتقنية الاتصالات الالكترونية.
