التسرب ..ألية من أليات البحث عن الدليل الجنائي في التشريعات الجنائية المعاصرة

Résumé: لقد شهدت الجزائر على غرار بلدان العالم تناميا سريعا في الجريمة ،نظرا للتطور السريع الذي عرفته المجتمعات المعاصرة وخاصة التطور التكنولوجي الرقمي ،الذي أحدث ثورة في مجالات متعددة الشيء الذي جعل مستغلو هذا التطور ينفذون مشاريعهم الإجرامية بكل سهولة ،حيث أضحت الأساليب الكلاسيكية غير فعالة في مجابهة ذلك ،الأمر الذي أدى بالمشرع الجزائري إلى استحداث أساليب جديدة للبحث والتحري عن الجرائم الخطيرة كأسلوب التسرب في جرائم خاصة ( المخدرات الجريمة المنظمة العابرة للحدود ،جرائم الإرهاب ،جرائم تبييض الأموال ،جرائم الصرف وجرائم الفساد ،وكذا الجريمة الماسة بأنظمة المعالجة الآلية ) .Following the other countries all over the world, Algeria has known an accelerated evolution of the crime ,due to the fast development of the contemporary communities especially the digital and the technological progress which in turn provoked a revolution in different fields which allowed a certain category of criminals to execute their criminal projects effortlessly ,whereas the classic methods are not efficient to any further extent to face these illegal deeds, the thing that obliged the Algerian legislator to create new methods of seeking and investigating dangerous crimes such as infiltration in special crimes ( drugs ,overseas organized crimes ,terrorism crimes ,money laundering, exchange crimes and corruption crimes and crimes ,cybercrime).
