حماية الملكية الفكرية الأدبية و الفنية في البيئة الرقمية في ظل التشريع الجزائري

Résumé: يعتبر موضوع الملكية الفكرية موضوع الساعة واحد المواضيع التي حاول الكثير تسليط الضوء عليها بقسميها صناعية وأدبية فنية فلم يعد هذا الموضوع حكرا على المختصين في مجال القانون فحسب بل درس من مناظير عدة. وفي موضوعنا هذا سوف يتم دراسة قسم الملكية الفكرية الأدبية والفنية وتحديدا حقوق المؤلف من منظور أخصائي المعلومات ، فسنحاول کشف الستار عن هذا الموضوع الذي دخل تخصص علم المكتبات وأوجب علينا ذلك التعريف بمصطلحاته والبحث في تاريخه ونشأته وأقسامه ثم التعمق أكثر في المشاكل التي طرحت في موضوع حقوق المؤلف في ظل التطورات التكنولوجية الحديثة ، من تعديات على حقوق المؤلفين في بيئة رقمية متطورة جدا بوابتها الواسعة هي شبكة الانترنت ونوافذها المتعددة هي مختلف الحوامل الرقمية الحديثة للمعلومات . وأخيرا سنقوم بعملية تقصي عن الإجراءات وردات فعل المشرع الجزائري حول هذا الموضوع على المستويين الدولي والداخلي علما أنه مواكب للأحداث رغم بطؤه في الإجراءات ويظهر وعيه بالانضمام للعديد من الاتفاقيات الدولية الهامة جدا في مجال الملكية الفكرية وتبني أفكارها ومبادئها خاصة الإدارة الجماعية لحقوق المؤلف . أما داخليا فذلك بإصداره للعديد من القوانين التي تحمي حقوق المؤلف وتحيينها في كل مرة وكان آخرها الأمر 03-05 والذي سيكون محل دراستنا هذه . Abstract: The topic of intellectual property is one of the topics that many tried to highlight with its industrial and literary artistic sections. In this subject we will study the section of intellectual and artistic intellectual property and specifically copyright from the perspective of information specialist, we will try to unveil this subject, which entered the specialty of library science and forced us to define its terms and research in its history and origin and sections and then to go deeper further in the problems raised in the subject of rights The author in the light of modern technological developments, from infringements on the rights of authors in a very sophisticated digital environment. Finally, we will investigate the procedures and reactions of the Algerian legislator on this subject at the international and internal levels .However, he keeps pace with events despite his slow procedures and demonstrates his awareness of joining many very important international conventions in the field of intellectual property and adopting its ideas and principles, especially collective management of copyright. Internally, it promulgates several laws that protect and update copyright every time
