الآليات القانونية لتسيير المساحات الخضراء-دراسة تحليلية على ضوء التشريع الجزائري

Résumé: بالعودة للمشرع الجزائري نجده وضع نظام قانوني خاص بالمساحات الخضراء له إرتباط وثيق بالبيئة، بإعتبار المساحات الخضراء مكون أساسي للطبيعة والبيئة، فتم تحديد شروط ومقاييس ومعايير تصنيفها يتم إحترامها من طرف السلطات المخولة بحمايتها، سواء إدارات وطنية كالوزارات أو المحلية كالبلدية والولاية بدون تغييب دور الجمعيات والنوادي القائمة في ذات التوجه البيئي. فالبرغم من حداثة الإهتمام بهذه المساحات وفقا للقانون 07/06 المتعلق بتسيير المساحات الخضراء وحمايتها وتنميتها، قطعت الجزائر أشواط كبيرة لتنمية هذه المساحات، بوضع نظام إداري وجزائي للمخالفين والمعتدين على هاته المساحات، ويبقى الدور الكبير للنهوظ بها على عاتق المجتمع، يعي دورها ويحافظ عليها وفقا لثقافة التنمية المستدامة. Returning to the Algerian legislator, we find that a legal system for green spaces has a close relationship with the environment, considering green spaces an essential component of nature and the environment. The conditions, standards, and criteria for their classification have been defined and respected by the authorities authorized to protect them, whether national administrations such as ministries or localities such as the municipality and the state without neglecting the role of associations and clubs. The list is environmentally oriented. Despite the recent interest in these spaces in accordance with Law 07/06 related to the management, protection and development of green spaces, Algeria has made great strides in developing these spaces, by establishing an administrative and penal system for violators and aggressors against these spaces, and the great role of protecting them remains on the shoulders of the community, aware of its role and preserving it in accordance with culture of sustainable development.
