مشكلـة النزاعـات المسلحـة الداخليـة المدولـة (أشكال جديدة تستدعي التأطير القانوني)

Résumé: إن تشعب وتضارب المصالح السياسية للدول، أدى إلى بداية ظهور مشكلة التدخل الخارجي في النزاعات المسلحة الداخلية، وباتت لهذه المسألة آثارها ليس فقط على ما تقوم عليه العلاقات الدولية من مبادئ أساسية وعلى رأسها حظر التدخل في الشؤون الداخلية للدول، ولكن أيضا في كيفية توصيف هذا النوع من النزاعات التي تنطوي على تدخل خارجي لصالح أحد الأطراف أو لجميع أطراف النزاع، الأمر الذي اوجد مصطلح النزاعات المسلحة الداخلية المدولة، هذا الأخير الذي خلق مشكلة في تحديد الطبيعة القانونية لهذه النزاعات وكذا بيان قواعد القانون الدولي الإنساني الواجبة التطبيق، خاصة وان هذا الشكل من النزاعات المسلحة يعد معقد للغاية نتيجة تعقيد الظروف التي أدت إلى تدويل النزاع ومظاهر التدخل العديدة التي تتجلى من خلالها، فهناك صعوبة حقيقية في وصف هذا النزاع طبقا لأحكام القانون الدولي الإنساني، الأمر الذي يستدعي ضرورة تدخل المجتمع الدولي لوضع تأطير قانوني لهذا الشكل من النزاعات المسلحة.
