التأصيل المفاهيمي لعقد الوكالة المحفزة كأسلوب لتسير المرافق العامة المحلية في ظل المرسوم التنفيذي 18-199 المتعلق بتفويضات المرفق العام

Résumé: نظرا للنقائص التي إعترت تسيير المرافق العامة وفعاليتها في تأدية مهامها وتحقيق النفع العام، قدر المنظم الجزائري وجوب البحث عن طرق أخرى للتسيير مجسدا إياها في أساليب تفويضات المرفق العام، وهو ما كرسه من خلال المرسوم الرئاسي 15-247 وأكد عليه وفعله من خلال المرسوم التنفيذي 18-199 المتعلق بتفويضات المرفق العام، ويعد أسلوب الوكالة المحفزة أحد هذه الأساليب المستحدثة، وهو أسلوب ذو طابع خاص من حيث عملية تسييره وأيلولة إستغلاله لحساب السلطة المفوضة. Due to the shortcomings in the functioning of public utilities and their effectiveness in carrying out their tasks and achieving public benefit, The Algerian Organizer estimated that other ways of governance should be sought, reflecting them in the methods of the general assembly’s delegations, which was regulated by presidential decree 15-247 and confermed by executive decree 18-199 on the mandate of the General Assembly.The Agency’s incentive method is one of these new methods, which is of a special nature in terms of the process of managing it and diverting it to the authority of the delegated authority
