المسؤولية الجزائية في حوادث العمل

Résumé: الملخص: تهدف هذه الدراسة إلى تحديد مفهوم حوادث العمل وتوضيح أحكام المسؤولية الجزائية المترتبة عن هذه الحوادث، وذلك من خلال توضيح المقصود بحادث العمل وكيفية إثباته والتصريح به من جهة، وتحديد مسؤولية المتسببين في وقوع حوادث العمل من جهة أخرى. توصلت الدراسة إلى أن المشرع الجزائري قد أولى عناية خاصة بحوادث العمل، وذلك لارتباطها الوثيق والمباشر بصحة وسلامة العامل، حيث أقر مجموعة من الشروط يجب توفرها في مكان وظروف العمل، ورتب على مخالفة ذلك مسؤولية جزائية تمس كل من كان السبب في وقوع هذه الحوادث. توصي الدراسة بضرورة تأمين بيئة العمل وذلك بتفعيل التشريعات الخاصة بها، بالإضافة إلى الاعتماد على توعية العمال في حد ذاتهم بضرورة احترام قواعد الأمن والسلامة في المحيط. الكلمات المفتاحية: حوادث العمل، المسؤولية الجزائية،العامل، بيئة العمل. Summary: This study aims to define the concept of work accidents and clarify the provisions of the penal responsibility arising from these accidents, by clarifying what is meant by the work accident and how to prove it and authorize it on the one hand, and determine the responsibility of those responsible for work accidents on the other hand. The study concluded that the Algerian legislator has paid special attention to work accidents, due to its close and direct connection to the health and safety of the worker, as head approved a set of conditions that must be met in the workplace and conditions, and arranged for a breach of that to be a criminal liability affecting everyone who was the cause of these accidents. The study recommends the necessity of securing the work environment by activating it special legislations, in addition to relying on educating the workers themselves on the need to respect the safety and security rules in the environment.
