مقـــــــاربة مفــــــاهيمية للضــــبط الصــحي في النــــصوص الــقانونية الـــجزائريـــة جائحة كوفيد19 نموذجا
Résumé: ورقتنا تسلط الضوء على التداعيات القانونية التي فرضتها الجائحة على المفاهيم القانونية على القواعد الدستورية و مركزها القانوني في ظل الحالات الاستثنائية التي تسمح لرئيس الجمهورية باتخاذ ما يراه مناسب لحماية امن الدولة من جهة و من جهة أخرى مركزها من مفهوم الضبط الإداري كمظهر من مظاهر السلطة العامة و وظيفة جوهرية للإدارة العامة ، بما تمارسه السلطات من أجل تنظيم نشاط و حرية الافراد و حماية النظام العام ، فدراستنا تهدف ابراز مفهوم الجائحة في القواعد الدستورية و الإدارية، في ظل اختلاف وجهات النظر ، و توصلنا الى مجموعة من النتائج و الحلول لتكييف الجائحة مع النصوص الوضعية . Our paper sheds light on the legal repercussions imposed by the pandemic on legal concepts on the constitutional rules and their legal status in light of the exceptional cases that allow the President of the Republic to take what he deems appropriate to protect the security of the state on the one hand and on the other hand its position from the concept of administrative control as a manifestation of public authority. An essential function of public administration, with what the authorities practice in order to regulate the activity and freedom of individuals and protect public order. .
