قاعدة لا ضرر ولا ضرار وتطبيقاتها في المعاملات المالية

Résumé: لما كان من غايات الشريعة الكبرى، مراعاة حظوظ المكلفين وإقامة العدل بينهم ، وذلك من خلال جالب المصالح لهم وتكثيرها، درء المفاسد عنهم وتقليلها، في العاجل والآجل، ولما كان باب المعاملات المالية من أكثر المجالات عرضة لتصادم المصالح بين الأفراد والجماعات، وسعيا لتحقيق أكبر قدر من الربح وبكل الوسائل، لان تحقيق المنافع من جهة يقابله حدوث الكثير من المفاسد إذا لم تكن المعاملة مضبوطة بضوابط الشرع الحنيف، فقد جاءت هذه الدراسة تبين مكانة قاعدة " لا ضرر ولا ضرار" في تنظيم المعاملات المالية في جميع المستويات، وذلك من خلال دفع الضرر قبل وقوعه ورفعه بعد وقوعه. الكلمات المفتاحية : ضرر ، ضرار ،قاعدة، معاملات مالية، أثر.
