الحماية الوقائية للمستهلك من مخاطر التجارة الالكترونية

Résumé: الملخص: شهدت دول العالم تباينا كبيرا في التعامل بالتجارة الإلكترونية؛ بين دول أصحبت فيها التجارة الالكترونية أهم وسيلة لتحقيق المعاملات والمبادلات ودول متحفظة بشأنها، إلا أن إنتشار الأمراض والأوبئة لاسيما كوفيد 19 أو جائحة كورونا، أكد على ضرورة وأهمية التجارة الالكترونية ودورها في الوقاية والحد من الأمراض من جهة وتيسير المعاملات والمبادلات من جهة أخرى، والإشكال المطروح يتمثل في مدى القدرة على توفير الحماية للمستهلك باعتباره الطرف الضعيف في المبادلات الالكترونية، هذه الحماية التي قد تكون وقائية أو علاجية، وتعد الحماية الوقائية ذات أهمية كبرى للمستهلك كونها تسبق إرتباطه بهذه المعاملات الالكترونية قبل أن يخرج الأمر من بين يديه، كحقه في الإعلام وحمايته من الاذإعلانات المضللة. Abstract: Countries around the world witnessed great variation in dealing with electronic commerce. Among countries in which electronic commerce has become the most important means of achieving transactions and exchanges and conservative countries regarding them, but the spread of diseases and epidemics, especially Covid 19 or the Corona pandemic, stressed the necessity and importance of electronic commerce and its role in preventing and reducing diseases on the one hand and facilitating transactions and exchanges on the other hand, and the problem presented It is represented in the ability to provide protection to the consumer as the weak party in electronic exchanges, this protection that may be preventive or therapeutic, and preventive protection is of great importance to the consumer as it precedes his association with these electronic transactions before the matter comes out of his hands, such as his right to be informed and his protection from Misleading ads.
