إستقلالية هيئة الرقابة الشرعية ودورها في ضبط اعمال المصارف الاسلامية

Résumé: هدفت هذه الدراسة إلى إبراز دور استقلالية هيئة الرقابة الشرعية في ضبط أعمال المصارف الإسلامية وذلك من خلال أن الاستقلالية تعتبر من أهم المعايير والمبادئ التي يقوم عليها عمل هيئات الرقابة الشرعية؛ من حيث تفاعلها وفاعليتها في إدارة المصارف الإسلامية والتي تستمد مصداقيتها من لدى الجمهور المتعامل معها بحيث تثبت من خلالها تحققها على الصعيد الواقعي والتطبيقي، وتزداد أهمية الدعوة إلى استقلالية هيئة الرقابة الشرعية في ظل واقع يشهد بضعف جهاز الرقابة الشرعية الآتي من ضعف الهيكل التنظيمي للإدارة بالمصارف الإسلامية والذي يترتب عنه التبعية لتلك الإدارات وكل ذلك ينعكس على كفاءة عمل المصارف الإسلامية، ومن هنا نطرح الإشكال الآتي: ما هو دور هيئة الرقابة الشرعية المستقلة في ضبط أعمال المصارف الإسلامية؟، وخلصت المذكرة إلى أن استقلالية هيئة الرقابة الشرعية تقتضي انفصالها نهائيا عن سلطة إدارات المصارف الإسلامية، وعدم خضوعها إلى لائحة أو نظام داخل المصرفي الإسلامي، وذلك من أجل أن تكون أداة فعالة في تطوير وضبط أعمال تلك المصارف، ولتحقيق المزيد من الشفافية والموضوعية في إدارتها لأعمالها.This study aimed to highlight the role of the independence of the Sharia supervisory board in controlling the work of Islamic banks, through that independence is one of the most important standards and principles upon which the work of Sharia supervisory boards is based in terms of its interaction and effectiveness in managing Islamic banks, which derives its credibility from the public dealing with it so that it proves Through it, it is achieved on a realistic and applied level, and the importance of calling for the independence of the Shariah Supervisory Board increases in light of the reality that witnesses the weakness of the Shariah supervisory body, which comes from the weakness of the organizational structure of the management in Islamic banks, which results in dependence on those departments, and all of this is reflected in the efficiency of the work of Islamic banks, and from here we put The following problem: What is the role of the independent Shariah Supervisory Board in controlling the work of Islamic banks? The memorandum concluded that the independence of the Shariah Supervisory Board requires its final separation from the authority of the departments of Islamic banks, and not being subject to a regulation or system within the Islamic banking, in order to be an effective tool in developing and controlling the work of these banks, and to achieve more transparency and objectivity in their management of their work.
