Résumé: ملخص: سارعت معظم الدول و خاصة بعد أحداث 11 سبتمبر 2001، إلى استصدار تشريعات في خطوة غير مسبوقة وصارمة تحت ذريعة مكافحة الإرهاب، حيث أنه من شأن هذه التشريعات تقويض حقوق الإنسان، و قد تركزت هذه التشريعات على الخصوص بالمساس بالحق في التنقل، بواسطة الإبعاد خاصة بالنسبة للأجانب المقيمين على إقليمها من جهة، و المنع من السفر بالنسبة لفئات أخرى سواء كانوا وطنيين أو أجانب، وقد أسفرت الدراسة على بيان نقاط الضعف و القوة في بيان اثر التشريعات في مجال حماية الحق في حرية التنقل من جهة و الوقاية و مكافحة الإرهاب من جهة أخرى. Abstract: Most countries, especially after the events of September 11, 2001, hastened to issue legislation in an unprecedented and strict step under the pretext of combating terrorism, as such legislation would undermine human rights, and these legislations focused in particular on compromising the right to movement, through deportation, especially for For foreigners residing on its territory on the one hand, and the travel ban for other groups, whether they are nationals or foreigners, and the study resulted in a statement of weaknesses and strengths in explaining the impact of legislation in the field of protecting the right to freedom of movement on the one hand, and prevention and combating terrorism on the other hand. .
