أحكام تزاحم مرضى وباء كورونا على الموارد الطبية في ضوء مقاصد الشريعة والقواعد الفقهية

Résumé: ملخص: من أخطر ما أحدثه فيروس كورونا المستجد (covid-19) هو اضعافه لقدرة المنظومة الصحية على استيعاب تقديم الرعاية الصحية اللازمة لجميع المرضى المصابين بهذا المرض، حيث أن سرعة انتشار الفيروس أدت إلى كثرة المصابين وازدحامهم في المستشفيات؛ وقد جاء هذا المقال ليبحث في المعايير الشرعية فيمن له أولوية العلاج فيكون أحق بالتقديم من غيره عند التزاحم. وقد تناول الباحث هذا الموضوع بعرض هذه النازلة على مقاصد الشريعة الإسلامية المتعلقة بحفظ النفوس، وما قعَّده علماء الإسلام من قواعد فقهية تضبط مسالك الترجيح بين أصحاب الحقوق عند تزاحمهم؛ وقد خلص البحث إلى وضع معايير الترجيح بين المرضى حال تزاحمهم على الموارد الطبية بما يحقق العدل الذي قامت عليه شريعة الإسلام. Abstract: One of the most dangerous results of Coronavirus (covid-19) is the weakening of the capacity of health system to provide the necessary health care to all infected patients. The widespread of the virus infected too many people and they overcrowded in hospitals. Therefore, this article aims at investigating the religious standards of who has the priority for treatment to skip the scrambling of patients. The researcher tackled this subject because of the Islamic Sharia’s purposeswhich are about Preserving souls, and Jurisprudential rules made by Islamic jurists to fix the pathways of equality between the scrambled patients. The research concluded that it is compulsory to make equal standards between patients when they scramble for medical resources to achieve justice according to Islamic religion.
