الحماية القانونية لحق الطفل في النسب

Résumé: إشكالية نسب الطفل تفرض نفسها على الواقع الاجتماعي ذاك أن الظاهرة منتشرة بشكل كبير بمختلف المجتمعات ،فتسعى التشريعات الى معالجتها بأدوات مختلفة ،في ضل تواجد الجهات الدينية المختلفة العاملة على التوعية بمخاطر الظاهرة ، سواء على الطفل بحد ذاته أو على المجتمع ، حيت تصدى قانون الاسرة لهذه الظاهرة و كذلك قانون العقوبات ،غير أن المشرع لم يستطع ضمان حق الطفل مجهول الوالدين وتحديدا ابن الزنا في النسب وكأنه يحمله وزر ذنب لم يقترفه ، كما أنه لم يتصدى لظاهرة انكار نسب الطفل. The issue of the child's filiation imposes itself on the social reality since the phenomenon is widespread in different societies . The legislation then aims to solve it with different tools in the presence of various religious organizations working to raise awareness of the risks of this phenomenon both for the child and for society . Although family law has adressed this phenomenon as well as criminal law, the legislator has not been able to guarantee the right of filiation of a person of unknown ascendants; specifically the son of adultery . More than that, the legislator has not dealt yet with the phenomenon of filiation denial.
