أحاديث نكاح المُحْرِم رواية ودراية

Résumé: ملخص: يهدف هذا البحث إلى حصر الأحاديث الواردة في نكاح المحرم بحجٍ أو عمرة حظرا أو إباحة ، وتمييز الثابت منها، مُتْبعاً ذلك بأقوال الصحابة وعملهم ، وما عليه العمل بعدهم ، وبيان مسالك أهل العلم تجاه الأخبار المتعارضة في هذه المسألة وجمع توجيهاتهم وتعليلاتهم ومناقشتها ، وكذلك بيان مذاهب الأئمة الأربعة والفقهاء المشهورين في مسألة نكاح المحرم. حيث ورد عن ابن عباس tـما في الصحيحين أن النبي  نكح ميمونة tـا وهو محرم ، وورد عن ميمونة صاحبة الشأن وسليمان بن يسار في صحيح مسلم ، وابن عمر ، وصفية بنت شبية ، وأبي رافع،  أنه نكحها وهي حلال! فما الثابت من الخبرين؟ وهل يمكن الجمع أم الترجيح ، وما توجيهات الأئمة؟. وماذا عن صحة رواية عائشة وأبي هريرة وفيها أنه  نكح ميمونة وهو محرم ؟! وهل ثبت عن ابن عباس خلاف قوله هذا ؟ وهل ورد عن ابن مسعود وأنس القول بجواز نكاح المحرم؟ وهل تراجع أنس عن قوله؟ وهل صح عن كبار الصحابة التفريق بين العاقدين حال الإحرام؟ فهذه أسئلة شائكة وأخبار متعارضة بحاجة إلى تحرير وبالله التوفيق. Prophetic Sayings in Pilgrim's Marriage: Accuracy and Narration Abstract This research aims to limit or specify the sayings related to pilgram's marriage either in Hajj or Umrah by examining its prohibition or legalization. The methodology of the research is based on following the statement of the Prophet Mohammad , peace be upon him, and his companions' work. The methodology is extended to study what has been done after the best two generations and explain in advance what other scholars have suggested in this issue with reference to the conflicts. A special concern has been made to the famous four parties in Islam and how did they comment on marriage in this particular statement.. In fact, Ibn Abbas has narrated in the Two Correct Books that Prophet Mohammad peace be upon him got married to Maimonah while he was a pilgrim. The same think applied for a second narration in Muslim's Book which proves that the Prophet himself married her in Hajj. So, as a result , which one of these contradicted sayings is true? Is it possible to combine these different standpoints ? It was reported that Anas Ibn Masood said that it is permissible to get married in this condition. Furthermore, Ans reported another narration which stated the opposite. Is it true that old companions differentiate between the two different kinds of marriage during Hajj. These are overlapping questions that need to addressed in this paper.
