حق القوامة و التعسف في استعمالها

Résumé: تعالج هذه الورقة البحثية موضوع من مواضيع العلاقة الأسرية، وهو التعسف في استعمال حق القوامة، فنظرية التعسف في استعمال الحق نظرية شرعية، وهي من أهم النظريات التي غيرت النظرة إلى الحق، من حق مطلق إلى حق مقيد في استعماله، وقد يطرأ التعسف في تطبيقه على حق في استعمال القوامة، فإذا أمضاه من غير سبب شرعي وأدى به إلى الإضرار بالزوجة فقد أساء استعماله، ، إلا أن التشريع وخاصة في قانون الأسرة الجزائري ، أعطى حماية قانونية تحد من تعسفات الزوج، فجعل للزوجة حق التطليق من أي ضرر أصيبت منه جراء تعسف الزوج في استعماله لحق القوامة. Abstract: This research paper examines one of the family relationship themes, which is the oppression of the right of guardianship. The theory of oppression in the use of the right is a legal theory, and it is one of the most important theories which changed the view of the right from an absolute right to a restricted right in its use, So,a man has a legitimate right, and if he performs it without a legitimate reason and leads him to harm the wife, he has abused it, However, the legislation, especially in the Algerian family Law, it gave legal protection that limits the oppression of guardianship
