جريمة خطف أو إبعاد قاصر دون عنف أو تهديد أو تحايل في قانون العقوبات الجزائري

Résumé: تعتبر جريمة الاختطاف من أخطر أشكال الإجرام والانحراف الاجتماعي التي تمس بأسمى حقوق الإنسان الجوهرية، كالحق في الحياة والحرية. يتعرض لها على وجه الخصوص، أضعف المخلوقات البشرية على وجه الأرض، لاسيما الأطفال القصر ذكورا وإناثا لم يكتملوا بعد سن الثمانية عشر من عمرهم، باعتبارهم أداة يسهل امتلاكها والعبث بها. تزداد خطورة هذه الجريمة إذا اقترنت بجرائم أخرى كالمتاجرة بالأعضاء، الاستغلال الجنسي، التوظيف في جرائم الإرهاب وغيرها. نظرا لتصاعد حالات اختطاف القصر، أعاد المشرع الجزائري النظر في نصوص قانون العقوبات واهتم بإيجاد آليات قانونية تجسد سياسته الجزائية في التصدي لهذه الجريمة، فأفرد أحكاما خاصة يجرم من خلالها كل أفعال الاختطاف مهما كانت طبيعتها، ويعاقب كل شخص تسول له نفسه خطف قاصر أو إبعاده دون عنف أو تهديد أو تحايل. The crime of kidnapping is one of the most serious forms of crime and social deviation that affects the most fundamental human rights, such as the right to life and freedom. The weakest human beings on earth, especially minor children, male and female, who have not yet completed their eighteen years of age are subjected to this crime, in particular, as they are a tool that is easy to possess and tamper with. The seriousness of this crime increases if it is associated with other crimes such as organ trafficking, sexual exploitation, employment in terrorist crimes and others. In view of the escalation of cases of minors kidnapping, the Algerian legislator reconsidered the provisions of the Penal Code and was interested in finding legal mechanisms that embody his penal policy in fighting against the crime of kidnapping. He created special provisions that criminalize all acts of kidnapping, whatever their nature, and punish any person who tempted himself to kidnap a minor or deport him without violence, threat or deception.
