الاستقرار القانوني في مجال الترقية العقارية

Résumé: يعتبر الاستثمار في مجال الترقية العقارية من أهم المجالات التي حظيت باهتمام المشرع الجزائري، سعيا منه لتوفير مناخ ملائم لجلب المستثمرين الذين أعطى لهم المشرع اسم المرقين العقاريين، ويجب توفير نوع من الأمن القانوني الذي يوفر لهم الحماية اللازمة ويرافقهم في الحصول على مصادر تمويل. ومن خلال هذه الورقة البحثية وجدنا أن عدم استقرار التشريع في مجال الترقية العقارية، أثر سلبا على جلب المستثمرين، لذلك خرجنا بنتيجة مفادها أن المشرع ملزم بالتأني في تعديل قانون الترقية العقارية ساري المفعول، بسد كل الثغرات القانونية لكي يكون اكثر استقرارا مما هو عليه حاليا. Abstract: Investment in the field of real estate development is one of the most important areas that has caught the attention of the Algerian legislator, a kind of legal security must be provided to the real estate developers that provides them with the necessary protection and accompanies them in obtaining financing sources.. Through this research paper, we found that the instability of the legislation in the field of real estate development negatively affects the attraction of investors, so we came to the conclusion that the legislator is obliged to carefully amend the law in force on real estate development, filling all the gaps in order to be more stable than it currently is.
