جائحة كورونا وانتهاء النشاط القانوني للهيئة المستخدمة

Résumé: سجلت جائحة كورونا انعكاسات اقتصادية واجتماعية، مست خاصة عالم الشغل وعقود العمل سواء تعديلها بما يسمح باستمراريتها أو إنهائها وهو ما يخلف تفاقم في البطالة. أمام النقائص المسجلة في منظومتنا القانونية فيما يخص التكفل بالفئة العمالية المتضررة من هذا الوباء، كان البحث عن طريق للحماية من خلال طرح إمكانية إدراج جائحة فيروس كورونا بوصفه قوة قاهرة ضمن الخالات المبررة لانتهاء النشاط القانونية للهيئة المستخدمة The Corona pandemic has recorded economic and social repercussions, especially the world contacts, whether by amending them to their continuation or termination, which creates an exacerbation of unemployment. Faced with the shortcomings recorded in our legal system regarding the sponsorship of workers affected by this epidemic, the search for a way of protection by proposing the possibility of including the Corona virus, as a force majeure, was among the cases justifying termination of the legal activity of the employing organization.
