الانسحاب من الاتفاقيات الدولية لحقوق الانسان

Résumé: ملخص: تتناول هذه الدراسة بالبحث والتحليل مسألة ذات أهمية في مجال القانون الدولي لحقوق الانسان، تتمثل في الانسحاب من الاتفاقيات الدولية لحقوق الانسان، الذي يعني تحلل الدولة من كافة التزاماتها بموجب اتفاقية ما، فرغم تشابه هذه الاتفاقيات في الخصائص إلا أن عددا كبيرا منها تتضمن نصا يجيز الانسحاب منها، فيما تجنبت أخرى على رأسها العهد الدولي للحقوق المدنية والسياسية أي إشارة إليه، مما أثار تساؤلا حول جواز الانسحاب منها بالنظر إلى خصائصها وطابعها الموضوعي. تمحورت مشكلة الدراسة حول أحكام الانسحاب من الاتفاقيات الدولية لحقوق الانسان وتوضيح الإجراءات الخاصة به، والوقوف على إشكالية جواز الانسحاب من الاتفاقيات التي لا تحتوي نصا يجيز الانسحاب منها، ثم بيان الآثار القانونية للانسحاب على الدول الأطراف في الاتفاقيات وعلى النظام القانوني الدولي لحقوق الانسان. Abstract: This study deals with research and analysis of an issue of importance in the field of international human rights law, which is the withdrawal from international human rights conventions, which means the state's disengagement of all its obligations under a convention, despite the similarity of these conventions in characteristics, but a large number of them contain a text that allows withdrawal from them, while others, headed by the International Covenant on civil and political rights, avoided any reference to it, which raised the question of the permissibility of withdrawal from them in view of their characteristics and objective nature. The problem of the study centered on the provisions of withdrawal from international human rights conventions and clarifying its procedures, and identifying the problem of the permissibility of withdrawal from conventions silent about denunciation, Then a statement of the legal effects of withdrawal on the states parties to the conventions and on the international legal system for human rights.
