الحماية الجزائية للطفل من الجريمة الإلكترونية في التشريع الجزائري

Résumé: الحماية الجزائية للطفل من الجريمة الالكترونية في التشريع الجزائري أولت الدولة الجزائرية موضوع حماية الطفل أهمية كبيرة وهذا ما تضمنته نصوص التشريع الوطنية والدولية التي صادقت عليها الجزائر، وبالرجوع الى أحكام قانون العقوبات الجزائري نجد أن المشرع الجزائري تناول الكثير من الأفعال التي تمس الطفل بالتجريم ، وبظهور الاجرام الالكتروني الذي كان نتيجة للتطور التكنولوجي والذي لم تعد القواعد القانونية التقليدية كافية لمواجهته، مما دفعنا لدراسة موضوع الحماية الجزائية للطفل من الجرائم الالكترونية في التشريع الجزائري من أجل معرفة وبحث مدى نجاعة الحماية المكرسة والنقائص والعراقيل، ومحاولة التوصل الى نظام قانوني واضح يضمن حماية للطفل أكثر نجاعة. الكلمات المفتاحية : الطفل، الحماية الجزائية ،مكافحة ،الشكوى الالكترونية ،فعالية Abstract : Child’sPenal protection fromcybercrime in Algerian law The Algerian state has given the issue of child protection great importance, and thisisincluded in the national and international legislativetextsratified by Algeria. Referring to the provisions of the Algerian Penal Code, wefindthat the Algerian legislatordealtwithcriminalizingmanyactsthat affect children, and with the emergence of electronic crime, whichwas a result of technologicaldevelopment and whichis no longer Traditionallegalrules are sufficient to confrontit, whichprompted us to study the issue of criminal protection of childrenfromelectronic crimes in Algerian legislation in order to know and research the extent of the effectiveness of the dedicated protection, the shortcomings and obstacles, and to try to reach a clearlegal system thatguarantees more effective child protection.
