قراءة نقدية في إحالة حالة للمحكمة الجنائية الدولية

Résumé: المحكمة الجنائية الدولية الركيزة الأساسية للعدالة الجنائية الدولية التي جاءت لتتجاوز عهد المحاكم الدولية المؤقتة بما يحمله من نقائص و عيوب، و التي كانت لها تأثيرات سلبية على مكافحة الإفلات من العقاب وعلى مبدأ حق الأفراد في محاكمة عادلة وفقا للأصول القانونية المتعارف عليها الراسخة في القانون الدولي، لكن بالرغم من ذلك مازالت المحكمة الجنائية الدولية تواجه عدة تحديات تحد من استقلاليتها المنصوص عليها في الفقرة التاسعة من ديباجة نظام روما الأساسي لسنة 1998 المؤسس لها.
