أثر الصلح والوساطة في تحقيق الأمن الأسري على ضوء الشريعة والقانون.

Résumé: تتناول هذه الدراسة أهم الآليات البديلة في تسوية النزاعات الأسرية والهادفة إلى تحقيق الأمن الأسري، الذي يعد عاملا أساسا وضرورة قصوى في حياة المجتمعات، حيث سعت الشريعة الإسلامية والقوانين الوضعية إلى تحقيقه على أكمل وجه، وذلك باتخاذ كل السبل والآليات الكفيلة بذلك. فالوساطة والصلح من أنجع السبل في تحقيق الأمن، ولقد حثت النصوص الثابتة القطعية على الاعتماد على الصلح كطريقة بديلة للتوفيق بين الزوجين. وهو ما أوجبه المشرع على القاضي كإجراء وجوبي يقوم به. وبالتالي؛ فهو صلح قضائي، كما نصت الشريعة على الاصلاح وذلك باتخاذ وسطاء يسعون بين المتخاصمين للاتفاق على حل وسط يرضي جميع الأطراف، وهذا ما استثناه المشرع من قضايا شؤون الأسرة، واكتفى بالتنصيص على إجرائي الصلح القضائي، والتحكيم. This study examines the most important alternative mechanisms in settling family disputes that aim to achieve family security, which is an essential factor in the life of societies. Islamic Sharia and positive laws have strived to achieve it to the fullest, by taking all necessary mechanisms to do so. Mediation and reconciliation are among the best ways to achieve family security, and therefore sharia texts urged the need to rely on reconciliation to combine the spouses. This was confirmed by the judicial legislation as an obligatory procedure. It is called a judicial reconciliation, and the law also stipulated reform by taking people seeking to reconcile the litigants by finding a compromise that satisfies all parties. This is what the legal legislator excluded from family affairs issues, and he merely provided for the provision of judicial reconciliation and arbitration.
