حرية التظاهر السلمي بين التنظيم الدولي والتشريعات الداخلية

Résumé: حرية التظاهر السلمي من الحريات الأساسية للأفراد، وتمثل جزاءا مهم من حرية التعبير، والغاية منها تحقيق أهداف ذات طابع سياسي أو اقتصادي أو اجتماعي، وقد يكون حتى رياضي. ويهدف هذا البحث إلى تبيان الأحكام التي تنظم ممارسة التظاهر السلمي، سواء على المستوى النصوص الدولية أو القانون الجزائري. و لقد تم تنظيمها و إدراجها ضمن النصوص الدولية من اتفاقيات ومعاهدات دولية، وامتدت إلى التشريعات الداخلية وتم التنصيص عليها دستوريا وتنظيمها في إطار قانون 89-28 المعدل بموجب القانون 91-19 المتعلق بالاجتماعات والمظاهرات العمومية. Freedom of peaceful demonstration is one of the basic freedoms of individuals, and it represents an important part of freedom of expression, and its purpose is to achieve goals of a political, economic or social nature, and it may even be an athlete. This research aims to clarify the provisions that regulate the practice of peaceful protest, whether at the level of international texts or Algerian law. And it has been organized and included in the international texts of international conventions and treaties, and extended to internal legislation and was stipulated in the constitution and organized within the framework of Law 89-28 amended under Law 91-19 related to public meetings and demonstrations.
