المسؤولية الجزائية كآلية ردعية للمتدخل الاقتصادي عند المساس بحق المستهلك في الإعلام

Résumé: ألزم المشرع الجزائري المتدخل الاقتصادي بضرورة إعلام المستهلك بكل المعلومات المتعلقة بالمنتَج المراد اقتناؤه، نظرا لاختلال التوازن المعرفي بين الطرفين، لكن مخالفة المتدخل الاقتصادي لهذا الالتزام، وقيامه بأفعاله من شأنها خداع وتضليل المستهلك تُوجب عليه المسؤولية الجزائية. يهتم هذا البحث بدراسة إحدى الآليات التي كرسها المشرع الجزائري لتحقيق الحماية القانونية للمستهلك وهي المسؤولية الجزائية للمتدخل الاقتصادي في عملية عرض المنتَج للاستهلاك، هذه المسؤولية تقوم في حالة ارتكابه لسلوك مجرّم قانونا يمس بحق المستهلك في الإعلام، وفي المقابل حدّد المشرع الجزائري جزاءات جنائية توقع على المتدخل الاقتصادي في حالة قيامه بأفعال تمس بحق المستهلك في الإعلام. The Algerian legislature has obliged the economic intervener to inform the consumer of all information concerning the product to be acquired, because of the cognitive imbalance between the two parties, but the violation of the economic intervener in this commitment and deceives the consumer has been a Criminal responsibility. This research is concerned with studying one of the mechanisms that the Algerian legislature has devoted to achieving the legal protection of the consumer, which is the criminal responsibility of the economic intervener in the process of offering the product for consumption, this responsibility is established if it is committed to the conduct of a criminal offense that affects the consumer's right to information. In return, the Algerian legislature has set criminal sanctions over the economic intervener if it does not comply with consumer information.
