النظام القانوني لاستخلاف أعضاء المجالس الشعبية المنتخبة في التشريع الجزائري

Résumé: يعتبر الانتخاب ضمانة أساسية لاستقلالية أعضاء المجالس الشعبية المنتخبة, إلا أنه قد تطرأ بعض الأسباب التي تؤدي إلى شغور مقاعدهم , وفق الأسباب التي حددها المشرع الجزائري من خلال قانون الانتخابات رقم 16/10, في المواد 105, 102, وذلك على سبيل الحصر لا المثال مما يستوجب استخلافهم بأعضاء آخرين. وتتمثل هذه الأسباب في : الاستقالة, الإقصاء, الوفاة, حدوث مانع شرعي والتجريد من العضوية بالإضافة إلى ذلك حالات التنافي الخاصة بإستخلاف أعضاء البرلمان وهي وظيفة عضو في الحكومة والعضوية في المجلس الدستوري, وعليه فإن هذه الدراسة تهدف إلى معالجة إشكالية كيف نظم المشرع الجزائري عملية الإستخلاف في المجالس الشعبية المنتخبة. The election is a basic guarantee for the independence of elected members of the People's Councils. However, some of the reasons that lead to the vacancy of their seats, according to the reasons established by the Algerian legislator through the electoral law No. 16/10, may be found in articles 105 and 102, They should be replaced by other members. These include: resigning, exclusion, death, the occurrence of a legal impediment and the exclusion of membership, in addition to cases of opposition to the use of members of parliament, a function of a member of the government and membership of the Constitutional Council. This study aims to address the problem of how the Algerian legislature organized the process of differentiation In elected popular assemblies.
