دور رئيس المحكمة في مجال التحكيم التجاري الدولي The Role Of The President Of Tribunal In The International Commercial Arbitration

Résumé: يعد التحكيم التجاري الدولي وسيلة بديلة لحل المنازعات التي تطرأ بين أطراف القانون الخاص بمناسبة المعاملات التجارية ذات الطابع الدولي و الذي يسمح للأطراف بتجنب التقاضي أمام الجهات القضائية الوطنية، و على الرغم من هذه المكانة، فإن التحكيم كنظام يفتقر لسلطة إلزام الأطراف ما يستوجب تدخل القضاء الداخلي و بخاصة رئيس المحكمة الذي يتمثل دوره في مساعدة الأطراف قبل صدور حكم التحكيم و بدور الرقيب بعد صدور هذا الحكم. الكلمات المفتاحية: التحكيم التجاري الدولي، محكمة التحكيم، حكم التحكيم، اتفاق التحكيم، شرط التحكيم، رئيس المحكمة. International commercial arbitration is an alternative method of resolving disputes between private parties arising out of commercial transactions conducted across national bonderies that allows the parties to avoid litigation in national courts, despite this important place, arbitration as a system does not have the power to oblige the parties wich makes it ineffective without the intervention of internal justice and especially of the president of tribunal, his role consists of assisting the parties before the arbitration award is rendered and by the role of the controller after this award is rendered
