مقاصد فقه الأسرة وأثرها في استنباط أحكامه المعاصرة

Résumé: يدرس ىذا البحث موضوع مقاصد فقو األسرة، عن طريق تتبع أحكام اخلطبة والنكاح وفرقو؛ من طالق دة، حماوال الكشف عن أىم ادلقاصد الشرعية مبختلف وخلع وإيالء وظهار ولعان، وع بينها العلماء يف كتب أنواعها و اليت أراد اهلل تعاىل حتقيقها من خالل تشريع أحكام األسرة، واليت التفسري وشروح احلديث والفقو ادلعتمدة عند ادلذاىب األربعة. وذلك من أجل بيان أمهية العلم هبذه ادلقاصد وتفعيلها يف الواقع العملي، وما فيها من حتقيق منافع عظيمة لألسرة، وبيان ما يف اجلهل هبا من خماطر، أو التهاون يف جتسيدىا عمليا من مفاسد تضر باألسرة واجملتمع بأسره. مث يبني البحث منزلة العلم هبذه ادلقاصد لدى الفقهاء، وقوة تأثريىا يف استنباط أحكام األسرة ادلعاصرة، عن طريق عرض وحتليل بعض ادلسائل ادلعاصرة اخلاصة باألسرة يف باب اخلطبة والنكاح والطالق والعدة.This paper studies the purposes of Fiqh of the family; represented in the engagement and the marriage and its termination by divorce, khula, iila, zihar, liean, and Iddah. In an attempt to uncover the most important legitimate purposes of the various types that God intended to achieve through the legislation of the family rulings. By extrapolating the most important among what the scholars had shown in the books of interpretation, and explanations of Hadith and Fiqh adopted by the four schools of thought. This is to demonstrate the importance of knowing these purposes and use them in practice, and their great benefits to the family. Also, demonstrate the danger of not knowing them or neglect using them in practice; great danger that affects the family and the society. The research shows the status of knowing these purposes among the scholars, and its influence on deducting the rulings of the modern family, by presenting and analyzing some modern issues of the family in the section of engagement, marriage, divorce and Iddah.
