إلتزام المورّد الإلكتروني بالتّسليم المطابق للطّلبية حماية للمستهلك الإلكتروني

Résumé: ملخص: إنّ قيام المورد الإلكتروني بتسليم منتوج للمستهلك الإلكتروني لا يكفي لتبرأ ذمته، بل لابد أن يكون ذلك المنتوج مطابقا للمواصفات القانونيّة والقياسيّة التي يشترطها كل من التّشريع وبنود العقد المبرم بين الطرفين المتعاقدين، وحرصا على تجسيد هذا الالتزام في تنفيذ عقود التجارة الإلكترونية لحماية المستهلك الالكتروني، نصّ المشرع الجزائري في القانون رقم 18-05 المتعلق بالتجارة الالكترونية على جملة من الجزاءات في حالة الإخلال به. ونهدف من خلال هذه الدراسة الى تسليط الضوء على تبيان خصوصية الالتزام بالتّسليم المطابق في تنفيذ عقود التجارة الإلكترونية، وكذا التأكيد أن الحماية التي قرّرها المشرّع للمستهلك الالكتروني من خلال الالتزام بتسليمه منتوج مطابق، يعد من أهم الضمانات القانونية التي تكرس الحماية الحقيقية والفعلية التي ينشدها المستهلك الالكتروني، باعتبار هذا الأخير طرفا ضعيفا في العقود الاستهلاكية المبرمة عن بعد في مواجهة الطرف القوي الا وهو المورد الالكتروني. Abstract: The electronic supplier’s delivery of a product to the electronic consumer is not sufficient to absolve him of his responsibility, rather that product must be in compliance with the legal and standard specifications stipulated by both the legislation and the clauses of the contract concluded between the two parties, in order to ensure that this commitment is embodied in the implementation of e-commerce contracts to protect the electronic consumer, in law° 18-05 related to electronic commerce, the Algerian legislator stipulated a number of penalties in case of breaching it. We aim through this study to shed light on the specificity of the commitment to conforming delivery in the implementation of e-commerce contracts, as well as to confirm that the protection decided by the legislator for the electronic consumer through the obligation to deliver a matching product, is one of the most important legal guarantees that devote the real and actual protection sought by the electronic consumer. , as the latter is a weak party in consumer .contracts concluded remotely in the face of the strong party, which is the electronic supplier
