التنظيم القانوني للإستثمار الوقفي في الجزائر.

Résumé: أصبح الاستثمار في الأملاك الوقفية من الآليات التي تساعد في تحقيق الاقتصاد الربحي والنهوض بالتنمية المتعددة المجالات، حيث وضع المشرع الجزائري شروط وكيفيات استغلال الاملاك الوقفية الموجهة لإنجاز مشاريع استثمارية ، رغبة منه في الاستفادة من هذه الأملاك التي لم تعد فائدتها مقتصرة على الجهة التي الموقوف لصالحها. وبذلك يكون المشرع قد حاول العمل على تثمين هذه الاملاك والاستفادة منها بما يخدم المصلحة العامة والخاصة، معتمدا في ذلك على مجموعة من الشروط القانونية الموجهة لإنجاز مشاريع استثمارية في مجال العقارات الوقفية التي جاء بها المرسوم التنفيذي رقم 18-213، انطلاقا من إبرامها بموجب عقد اداري بين السلطة المختصة والمستثمر، فيمكن لكل الأشخاص سواء كانوا طبيعيين أو معنويين الخاضعين للقانون الجزائري الترشح للاستفادة من الاملاك الوقفية والاستثمار فيها واستغلالها في اطار ما تنص عليه القوانين وما توجبه من شروط يجب الالتزام بها واحترامها في عملية الاستثمار والاستغلال لهذه الأملاك Summary : Investing in Waqf properties has become one of the major assets that contribute to the realization of a profitable economy and the promotion of multidisciplinary development, where the Algerian Sharia sets the conditions and methods of operating Waqf properties from large, continuous and permanent properties. Their usefulness is no longer limited, as before, to the party in whose favor it is suspended. The legislator therefore attempted to work on the valuation of these assets and to profit from them in the service of the public interest of the state and the private interests of the members of the community by relying on the facilitation of this process. on a set of legal conditions intended for the realization of investment project in the field of the endowment as indicated in the executive decree n ° 18-213, on the basis of an administrative contract enter the competent authority and the investor , all persons, natural or legal, subject to Algerian law, can request, benefit from and invest in and use Waqf property within the framework of the laws in force and their obligations.
