التكييف القانوني لجريمة القذف عبر مواقع التواصل الاجتماعي في التشريع الجزائري

Résumé: تمثل جريمة القذف عبر مواقع التواصل الاجتماعي إساءة لاستخدام هذه المواقع لأغراض سلبية نتيجة قلة الوعي بالمخالفات القانونية المرتكبة، وبين الحرية المطلقة في التعبير والتعسف فيها. وذلك كون عنصر العلانية الذي تستوجبه واقعة القذف يتوافر بصفة مباشرة في مواقع التواصل الاجتماعي بمجرد نشرها، واكتمال أركان هذه الجريمة، والتي يتم تكييفها في التشريع الجزائري من خلال النصوص التقليدية لجريمة القذف، وتختلف صور القذف فيها باختلاف محل القذف، الإضافة إلى بساطة عقوباتها في التشريع الجزائري. The crime of defamation through social media sites is a misuse of these sites for negative purposes due to a lack of awareness of the legal violations committed and absolute freedom of expression and abuse, As the public element required by ejaculation is directly available in social networking sites as soon as they are published, And the completion of the elements of this crime, Which are adapted in Algerian legislation through traditional texts of defamation, the images of libel differ in different places of libel, in addition to the simplicity of their penalties in Algerian legislation.
