الطـــلاق التعسفـــي فـــي الفقـــه و القانـــــون

Résumé: الطلاق صورة من صور فك الرابطة الزوجية ، و هو حق اصيل للرجل يمارسه في اي وقت يشاء و ذلك بموجب العصمة المقررة له شرعا ، الا ان هذا الحق ليس على اطلاقه و انما قد يكون مقيدا ، و بالرغم من وجود هذه القيود قد يوقعه الزوج بدون حاجة تدعو اليه و هذا ما يعرف بالطلاق التعسفي ، الا ان الشرع و القانون باقرارهما هذا الحق للزوج لم يقفا عاجزين عن المحافظة عنة حقوق المرأة و ذلك باقرار التعويض عن كل ضرر يلحق بالزوجة عند اساءة استعمال هذا الحق من طرف الزوج . فالحكم بالتعويض عن الضرر الذي يلحق بالزوجة من شأنه ان يحد من اقدام كثير من الازواج على ايقاع الطلاق ، الا اذا دعت الضرورة اليه و بوجود مبرر شرعي ، وذلك بغرض الحفاظ على الحياة الزوجية و استمرارها. و عليه فان مسألة التعويض تبقى متعلقة بالضرر الناتج من جراء ايقاع الطلاق ، و المشرع الجزائري لم يوضح او يفرق بين المدخول بها و غير المدخول بها ، و قد اصاب المشرع الجزائري في عدم تقدير قيمة التعويض و ذلك لأن صور التعسف و معاييره تختلف و يختلف معها الضرر و من المنطقي و الطبيعي ان يختلف مقدار التعويض . و للقاضي السلطة التقديرية في تقدير الضرر و جسامته و مدى كونه موجبا للتعويض . الكلمات المفتاحية: الطلاق التعسفي، الضرر، التعويض.
