عمل المرأة و أثره على العلاقة الزوجية -دراسة فقهية معاصرة

Résumé: "موضوع المذكرة موسوم بـ: ""عمل المرأة وأثره على العلاقة الزوجية دراسة فقهية معاصرة""، وإشكاليته الرئيسة تبحث في مدى أثر عمل المرأة في المسائل المالية، وغير المالية بين الزوجين. وقد تمت معالجة الإشكالية في ثلاثة مباحث: المبحث الأول؛ خُصِّصَ لدراسة مشروعية عمل المرأة، والضوابط التي يجب على المرأة العاملة الالتزام بها، مع ذكر أهم الدوافع لخروجها للعمل. فيما تعرض المبحث الثاني لأثر عمل المرأة على العلاقة الزوجية في المسائل المالية ابتداء بأثر عملها على نفقتها، وانتهاء بمدى إلزامية مشاركتها في نفقات البيت. أما المبحث الثالث؛ فتَضَمَنَ أثر عمل المرأة على علاقتها بزوجها في بعض المسائل غير الماليةكاشتراط العمل في عقد الزواج، وحكم سفر المرأة العاملة، ومدى مشروعية استخدامها لوسائل التواصل الاجتماعي في مجال عملها. ومن أهم النتائج التي توَصَلت إليها هذه الدراسة أن النفقة حق ثابت للزوجة إذا أذن لها زوجها بالعمل، وتُعتبر مساهمتها في نفقتها، أو نفقات البيت تطوعا، ومن باب المعاشرة بالمعروف، كما أن اشتراط المرأة العاملة المشاركة في التملك، وسفرها، واستخدامها لوسائل التواصل الاجتماعي تَحكمه ضوابط شرعية، وأوصت الدراسة بتجديد البحث في الفقه المتعلق بقضايا المرأة، خاصة ما تعلق منها بالأسرة؛ وفق منهج وسطي معتدل مستنده الأصلي النص الشرعي، مع مراعاة مستجدات العصر، ومقاصد الشرع. ""The subject of the research is titled: ""Women's work and its impact on the marital relationship، a contemporary jurisprudential study."" Its main problem is about the impact of women's work on financial and non-financial issues between spouses.The problem has been addressed in three sections: the first topic devoted to the study of the legitimacy of women's work، and the limits that a working woman must adhere to it، and the most important motivations for leaving her work. While the second topic dealt with the impact of women's work on the marital relationship in financial matters، starting with the effect of her work on her expenses، and ending with the extent of her mandatory participation in household expenses. The third topic included the impact of a woman's work on her relationship with her husband in some non-financial issues، such as the work requirement in the marriage contract، the ruling on working women traveling، and the legality of their use of social media in their field of work. One of the most important results of study is that maintenance is a fixed right of the wife if her husband permits her to work، and her contribution to her alimony، or the expenses of the house is considered voluntary، and it is a matter of good cohabitation، and the requirement of a working woman to participate in ownership، her travel، and her use of social media is governed by religious limits، also the study recommended renewing research in jurisprudence about women’s issues، especially those related to the family; According to a moderate approach whose original basis is the legal text، taking into accounts requirements of time، and the purposes of Sharia "
