التحصيل الجبري إلشتراكات الضمان اإلجتماعي في التشريع الجزائري

Résumé: التحصيل الجبري الشتراكات الضمان االجتماعي ىو عممية قانونية يتم المجوء إلييا بعد استنفاذ الطرق الودية العادية وذلك لضمان دفع المكمفين لمستحقاتيم لصناديق الضمان االجتماعي ، والتي يتم تحصيميا عند االمتناع أو عدم الوفاء بااللتزامات المالية تجاه نظام الضمان االجتماعي في اآلجال المحددة . وتيدف ىذه الدراسة إلى بيان آليات وطرق تحصيل اشتراكات الضمان اإلجتماعي في التشريع الجزائري وفق اإلجراءات الجبرية نظرا ألىميتيا التي تكمن في ضمان التمويل والفعالية القانونية وحماية الحقوق وتحقيق العدالة والوقاية من التعسف . واإلجراءات الجبرية تشمل عدة طرق وآليات منيا المالحقة والجداول والمعارضة عمى الحسابات الجارية ، واإلقتطاع من القروض ، أوامر األداء ، والمجوء إلى القضاء واعتمدنا في دراستنا عمى المنيج التحميمي الذي يرتكز عمى تحميل القوانين والتشريعات المتعمقة بالضمان اإلجتماعي والتحصيل الجبري مثل القانون 08/08 . وتوصمنا إلى جممة من النتائج لعل أبرزىا أن ىيئة الضمان اإلجتماعي تواجييا الكثير من الصعوبات في تحصيل مستحقاتيا نتيجة التماطل والتأخير وأحيانا اإلمتناع عن تسديد االشتراكات من طرف المكمفين ، وكذا الواقع العممي الذي أفرز عدة إشكاالت تعتري عممية التحصيل الجبري . ومن بين التوصيات واالقتراحات التي تقدمنا بيا ضرورة تبسيط إجراءات التحصيل ، وتعزيز اإلجراءات العقابية وجعميا أكثر صرامة لكل ممتنع ، باإلضافة إلى رقمن القطاع وبطو بالمؤسسات المالية لمتنسيق والتعاون .Compulsory collection of social security contributions is a legal process resorted to after exhausting ordinary amicable methods. This ensures that liable parties pay their dues to social security funds, collected when there is refusal or failure to meet financial obligations towards the social security system within the specified deadlines. This study aims to outline the mechanisms and methods for collecting social security contributions in Algerian legislation according to compulsory procedures, given their importance in ensuring funding, legal effectiveness, protecting rights, achieving justice, and preventing abuse. Compulsory procedures include several methods and mechanisms such as prosecution, schedules, opposition to current accounts, deduction from loans, performance orders, and recourse to the judiciary. Our study adopts an analytical approach that focuses on analyzing laws and legislations related to social security and compulsory collection, such as Law 08/08. We concluded with several findings, the most notable being that the Social Security Authority faces many difficulties in collecting its dues due to procrastination, delays, and sometimes refusal to pay contributions by liable parties. The practical reality has also revealed several issues that impede the compulsory collection process. Among the recommendations and suggestions we proposed are the need to simplify collection procedures, strengthen punitive measures and make them more stringent for anyone refusing to pay, and digitize the sector and link it with financial institutions for coordination and cooperation.
