رقابة القاضي الإستعجالي الإداري على المال العام في مادة التسبيق المالي على ضوء أحكام قانون الإجراءات المدنية والإدارية 08-09المعدل والمتمم بالقانون22-13

Résumé: استحدث المشرع الجزائري من خلال الإجراءات المدنية والإدارية 08/09المعدل والمتمم ،قضاء الاستعجال في مادة التسبيق المالي اين خصص له الفصل الرابع من الباب الثالث وذلك من المواد942الى 945 ، وهو عبارة عن تقنية قضائية تمكن الدائنين من الحصول على تسبيقات مالية عبر قضاء الاستعجال الاداري دون انتظار الفصل في دعوى الموضوع وما تعرفه من اجراءات طويلة لاسيما في حالة استعانة محكمة الموضوع بالخبرة الحسابية لتحديد قيمة الدين ،او في الحالة التي يطعن فيها المدين بالاستئناف الموقف لتنفيذ الحكم طبقا للمادة 900مكرر 2 و908 من الإجراءات المدنية والإدارية ،هنا تظهر الاهمية الواقعية لهذه الالية القانونية -موضوع الدراسة - التي تحاول هذه الورقة البحثية الالمام باهم جزئياتها خصوصا ما تعلق بالشروط القانونية الواجب توفرها في طلب التسبيق المالي وعلاقة ذلك بحماية المال العام ،والاثار القانونية للامر الاستعجالي الفاصل في طلب التسبيق المالي. Abstract: The Algerian legislator, through the amended and supplemented Civil and Administrative Procedures Law 08/09, has established urgent jurisdiction in the matter of financial advances, dedicating Chapter Four of Title Three to it, specifically from Articles 942 to 945. This represents a judicial technique that enables creditors to obtain financial advances through administrative urgent jurisdiction without waiting for a ruling on the substantive case, which is often accompanied by lengthy procedures, especially in cases where the court of first instance relies on expert accounting assessments to determine the debt amount, or in situations where the debtor appeals against the suspension of the execution of the judgment according to Articles 900 bis 2 and 908 of the Civil and Administrative Procedures Law. Herein lies the practical importance of this legal mechanism—subject of study—that this research paper aims to cover, particularly concerning the legal conditions that must be met in the request for financial advances and its relation to the protection of public funds, as well as the legal effects of the urgent order deciding on the request for financial advances."
