الإشكالات القانونیة لتطبیق الحكم الراشد في الجزائر

Résumé: تعالج هذه الدراسة مدى ملائمة السیاسات التشریعیة الوطنیة لتطبیق نموذج الحكم الراشد، هذا الأخیر الذي یعد من أولویات الدولة الجزائریة باعتباره أحد أهم الشروط الأساسیة لتحقیق التنمیة المستدامة. و من أجل ذلك، تسعى هذه الدراسة في إطار مقاربة الحكامة القانونیة البحث في مختلف التشریعات الوطنیة للوقوف على أهم الإشكالات القانونیة التي تعیق عملیة ترشید الحكم في مختلف مجالاته السیاسیة، الإداریة، الإقتصادیة و الإجتماعیة. و ذلك من أجل اقتراح الحلول الكفیلة لإصلاح اختلالات المنظومة التشریعیة في هذا المجال، تحقیقا للتنمیة المستدامة باعتبارها جوهر قیام الحكم الراشد في الجزائر. This study treats the extent to which national legislative policies are compatible to apply the model of Good Governance, which is one of the top priorities for the Algerian State considering it one of the main conditions to implement sustainable development. For this purpose, this study aims under the framework of legal governance approach to search different national legislations to stand for the most important legal problematics that form an obstacle for the application of Good Governance in its different fields, the political, administrative, economic and social fields. That is in order to suggest solutions enough to fix the imbalances of the legislative system in this subject, implementing sustainable development considering it the core of Good Governance implementation in Algeria.
