الأحكام الموضوعية لجريمة الإختلاس في القطاع الخاص

Résumé: ملخص: تعتبر جريمة الإختلاس في القطاع الخاص أحد الصور المستحدثة في قانون 06-01 المتعلق بالوقاية من الفساد ومكافحته، والتي خصها المشرع الجزائري بأحكام موضوعية دقيقة عن جريمة الإختلاس التي ترتكب من طرف الموظف العمومي بوصفه جاني، وحيث تهدف الدراسة إلى تحليل أركان الجريمة والتدابير والعقوبات المرصودة للوقاية منها وردعها، حيث اعتمدت الدراسة على المنهج الوصفي لوصف ظاهرة الفساد، بالإضافة إلى المنهج التحليلي لتحليل النصوص القانونية من أجل الوصول إلى نتائج تجيب عن الإشكال المطروح. حيث بينت الدراسة أنه رغم حرص المشرع على مكافحة الجريمة إلا أنه لم يوفق في كثير من الصور التي يمكن أن تكون يشملها التجريم وكذلك بالنسبة للعقوبات فهي تبقى غير ذي جدوى بالمقارنة بالآثار السلبية للجريمة. Abstract: The crime of embezzlement in the private sector is one of the images created in Law 06-01 related to preventing and combating corruption, which the Algerian legislator has singled out for precise objective provisions on the crime of embezzlement committed by a public official as a perpetrator, and where the study aims to analyze the elements of the crime and the measures and penalties allocated for prevention The study relied on the descriptive approach to describe the phenomenon of corruption, in addition to the analytical method for analyzing legal texts in order to reach results that answer the problem at hand. Where the study showed that despite the legislator’s keenness to combat crime, he was not successful in many of the forms that could be included in the crime, as well as with regard to penalties, as they remain useless compared to the negative effects of the crime.
