التكريس القانوني والقضائي لمبدأ الحيطة في مجال حماية البيئة

Résumé: ملخص: يعتبر مبدأ الحيطة من أهم المبادئ الحديثة في القانون الدولي للبيئة، و من خلاله تقوم الدول باتخاذ التدابير اللازمة لاستدراك تدهور البيئة حتى في حالة غياب اليقين العلمي القاطع حول الآثار الناجمة عن الأنشطة المزمع القيام بها. ويتميز هذا المبدأ بميزة التنسيق والتوقع فهو موجها كليا أو جزئيا نحوا لمستقبل. ومن بين أهداف البحث هي إبراز دور مبدأ الحيطة في التشريعات الداخلية والاتفاقيات الدولية، والتعرف على التطبيقات القضائية لهذا المبدأ في مجال حماية البيئة. و قد كرسته جميع الاتفاقيات الدولية ذات الصلة وأخذت به التشريعات الوطنية، وطبقه القضاء سواء تعلق الأمر بالقضاء الدولي أو الأجهزة القضائية الإقليمية. وتشمل النتائج المتوصل إليها من خلال دراسة هذا الموضوع تكريس مبدأ الحيطة في الاتفاقيات الدولية والتشريعات الوطنية ومنها القانون الجزائري رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة. Abstract : The principle of vigilance is one of the most important modern principles in international environmental law, through which States take the necessary measures to redress environmental degradation even in the absence of definitive scientific certainty about the effects of planned activities. This principle has the advantage of coordination and expectation and is wholly or partially oriented towards the future. One of the research's objectives is to highlight the role of the precautionary principle in domestic legislation and international conventions and to identify the judicial applications of this principle in the field of environmental protection. It has been enshrined in all the relevant international conventions and incorporated into national legislation, and has been applied by the judiciary, whether it relates to international justice or regional judicial bodies. The findings reached through the study of this subject include the enshrinement of the principle of prudence in international conventions and national legislation, including Algeria's Act No. 03-10 on the protection of the environment in the context of sustainable development.
