الإغتصاب الزوجي في ضوء القانون الدولي والتشريع الجزائري والشريعة الإسلامية

Résumé: في إطار حماية المرأة تم تعريف العنف ضد المرأة وتجريمه ودعوة الدول الأطراف في الإتفاقيات الإطار إلى ضرورة تضمين قوانينها الداخلية تجريما للعنف الموجه ضد المرأة، ويدخل في نطاقها: العنف الجنسي؛ ويشمل هذا الأخير الإغتصاب الزوجي. الذي هو كل معاشرة تمت بين الزوجين ولم توافق عليها الزوجة، ويعتبر جريمة في ضوء القانون الدولي. وفي الجزائر جرم المشرع فعل الإغتصاب عموما، ولم يتطرق لأنواع الإغتصاب، ولم يذكر الإغتصاب الزوجي، ومع ذلك يرى بعض الفقه كفاية القواعد العامة لتجريم الإغتصاب الزوجي. أما في الشريعة الإسلامية فمن الخطأ القول أن نص الإغتصاب يشمل المتزوجين أيضا، لأن في هذا مساواة بين العلاقة الشرعية والعلاقة غير الشرعية. Within the framework of protecting women, violence against women has been defined and criminalized, and states parties to the framework conventions have been called upon to include in their domestic laws a criminalization of violence directed against women, which includes: sexual violence; The latter includes marital rape. Which is every intercourse that took place between the spouses and was not approved by the wife, and is considered a crime in light of international law. In Algeria, the legislature criminalized the act of rape in general, and did not address the types of rape, nor did it mention marital rape. However, some jurisprudence believes that the general rules are sufficient to criminalize marital rape. As for Islamic law, it is wrong to say that the text of rape includes married people as well, because this constitutes equality between the legal relationship and the illegal relationship.
