The Principle Of The Right To Litigation As A Guarantee For A Fair Trial- A Comparative Legal Study- In Accordance With National Legislation , International Conventions And Algerian Jurisprudence

Résumé: الملخص: يتناول هذا المقال دراسة و تحليل الحق في التقاضي أو حق اللجوء إلى العدالة لكل شخص طبيعي أو معنوي للحصول على حقه، من أجل تحقيق محاكمة عادلة، و يكون ذلك عن طريق الدعوى القضائية، بإعتبارها سلطة ممنوحة بموجب القانون للشخص للحصول على الحماية القضائية وفقا للإجراءات القانونية المحددة في قانون الإجراءات المدنية و الإدارية 08-09 المؤرخ في 25/02/2008. كما أن مبدأ حق التقاضي مكرس في الدستور الجزائري لسنة 1996 إلى غاية آخر التعديل الدستوري لسنة 2020، وهذا تماشيا مع مختلف التشريعات والمواثيق و المعاهدات الدولية التي تعترف بهذا الحق الشرعي بإعتباره من الحقوق الأساسية للمواطن.لكن لهذا الحق حدود أو قيود عبر عنها المشرع الجزائري في القانون 08-09 بـ " التعسف في استعمال الحق التقاضي". Abstract: This article deals withe the study and analysys of the right to litigation or the right to justice for every natural or moral person to obtain his right In order to achieve a fair trial through lawsuit, as an authority granted by law to a person to obtain judicial protection in accordance with the legal procedures specified in the Civil and Administrative Procedures Law 08-09 dated on 25/02/2008. The principle of the right to litigate is enshrined in the Algerian constitution of 1996 until the end of the constitutional amendment of 2020. This is in line with the various lesgislations, charters and international teraties that recognize this legitimate right as one of the basic rights of the citizen, but for this right there are limits or restrictions described by the accellerator according to Lawe No. 08-09 withe the term « abuse of the to litigation ».
