المحاكمة المرئية عن بعد: تكريس لعصرنة العدالة أم مساس بالضمانات

Résumé: لجأت الجزائر إلى إعمال المحاكمة عن بعد تكريسا لعصرنة العدالة لما توفره التكنولوجيا من سرعة ودقة، وتوفير للجهد والمال، وربحا للوقت، وكان ذلك بداية بإصدار القانون رقم: 15/03 المتعلق بعصرنة العدالة الذي اتجه الى استعمال التكنولوجيا في العمل القضائي، وهو الأمر الذي تطلب إصدار قانون أخر المتمثل في الأمر رقم:20/04 المعدل والمتمم لقانون الاجراءات الجزائية، وهذا للتكريس العملي للمحاكمة عن بعد، ومنه أصبحت المحاكمة الكترونية من بدء سير الدعوى العمومية إلى غاية اصدار الحكم، غير أن ذلك خلق عدة اشكالات قانونية تتعلق بضمانات المحاكمة العادلة على غرار مبدأ الاقتناع الشخصي للقاضي، و مبدأ علنية المحاكمة، وحق المتهم من الاستفادة من المشاعر الإنسانية للقاضي كلمات مفتاحية: المحادثة المرئية عن بعد.، عصرنة العدالة.، ضمانات المحاكمة العادلة.، المثول عن بعد.،الاتصال عن بعد Abstract: Algeria has resorted to the implementation of remote trial in order to modernize justice due to the speed and accuracy of technology, trying to save effort, money, and time. The beginning was with the issuance of Law No 03/15 related to the modernization of justice, which tended to use technology in judicial work. This required the issuance of another law called: law No.: 20/04 amending and supplementing the Code of Criminal Procedure in an attempt to practically apply the trial at a distance. Thus, the trial has become electronic from the start of the public case to the issuance of the judgment. However, this has created several legal problems related to fair trial guarantees such as: the principle of personal conviction of the judge, the principle of public trial, and the right of the accused to benefit from the human feelings of the judge
